Any order of an item offered on the site implies the consultation and express acceptance of these General Conditions UseHowever, this acceptance is not conditional on a handwritten signature by the User.

The present General Conditions Use apply, without restriction or reservation, to all sales concluded by DMN with non-professional buyers wishing to acquire the items offered for sale by the Seller on its website mentioned above.

These General Conditions Use are accessible at all times on this website and will prevail, if necessary, over any other version or any other contradictory document.

Unless proven otherwise, the data recorded by DMN constitutes proof of all transactions.

According to the legal provisions, it is recalled that the validation of an order is carried out by clicking on the button "I confirm my order". This validation constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature and is proof of the completeness of the order and the due payment of the sums owed in execution of the said order. In all cases, the online supply of the credit card number and the final validation of the order will be proof of the whole of the said order and will be chargeable of the sums incurred by the seizure of the items on the order form.

Access to the DMN site is carried out under normal Internet connection conditions. No additional connection costs will be charged to the user.

These General Conditions Use The conditions applicable are those in force at the date of placing your order. The editing and saving of these conditions are the responsibility of the Buyer.

Art. 1. Purpose

The present General Conditions Use The purpose of these conditions is to define, exclusively because of the relations that the Parties establish on the Internet network, their respective rights and obligations resulting from the online sale of products offered on the site. These conditions regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the contracting Parties.

The Parties agree that their relationship will be governed exclusively by this agreement. If a condition were to be lacking, it would be considered to be governed by the usages in force in the distance selling sector whose companies are headquartered in France.

Art. 2 Articles - Prices

2.1 Article

Part of the items is purchased directly from suppliers to form a pre-stock, the other part is ordered post sale according to the number of orders made by the buyers.

In case of unavailability of an item after the order, due to a problem of delivery of our suppliers or a discrepancy of stock, the buyer will be informed by e-mail upon receipt of the information communicated by the supplier or the Logistics Department. The cancellation of the unavailable item and its reimbursement will then be made, the remainder of the order remaining firm and definitive.

2.2 Price

The prices are indicated in euros, they take into account any reductions as well as the VAT applicable on the day of the order.

The prices indicated are guaranteed within the limit of the stocks available, except for significant changes in the charges and in particular VAT, and unless typographical or omission error. The prices indicated do not take into account the delivery charges which will be charged in addition and will be specified to the user when the final validation of his order.

DMN reserves the right to modify its prices at any time, but the Articles will be invoiced on the basis of the prices in force at the time the order is registered, subject however to the availability of the said Articles.

When a validated order contains one or more erroneous elements (price, description, photo, coupon...), DMN reserves the right to cancel it and to reimburse the latter.

Art. 3. Registering and validating the order

3.1 Navigation inside the site

The user can take note of the various articles offered for sale by DMN on his website.

The user can freely navigate the different pages of the site, without being hired as an order.

3.2 Registration and password

Registration is necessary and obligatory to place an order. The user will be required to complete the "sign-up" form available in the "My Account" section. In particular, he will include the information necessary for his identification and, in particular, his names and forenames, his postal address, his valid e-mail and password.

DMN guarantees the confidentiality of the data transmitted after the entry of the password. The user is liable for the use of his password. It ensures its preservation as well as its confidentiality. In case of loss of said password, the user must contact DMN as soon as possible so that a new password is assigned to him.

In case of a forgotten password, the user can obtain a new one by clicking on the link "forgotten password" displayed in the Identification section. The reset procedure will be sent to him by mail.

Upon the creation of his account, the user may authorize DMN to send him by mail the invitations to the sales as well as the communiqués of the DMN team.

3.3 Registering an Order

The user passes his order via an Internet connection allowing him to browse the site. In order to be accepted, its order must bear all the necessary and useful indications for its treatment. In addition, any order is valid for acceptance of the general terms of sale, prices and description of the items available for sale.

It is not possible to make an order from a country not included in the list of destination countries authorized by DMN.

If the user wants to order, he will select the various articles that interest him and show his interest by clicking on the box "add to Cart".

At any time, the user may:

-Get a summary of the items he selected, by clicking on "My Cart"

-Continue its selection of Articles by clicking on "continue shopping"

-Finish its selection of articles and order the articles by clicking on "I Confirm my order"

To order the selected items in his cart, the user must identify himself, either by entering his email and password if he has already created his account at DMN, or by filling in the form "register" in the case opposite.

The user is informed and accepts that the entry of these two identifiers to access his client account (email address and password) is proof of his identity and confirms his consent.

Once the user has been identified, an order summary will appear on the screen stating: The Nature, quantity and price of the item (or items) retained by the user and then he must validate the delivery address, as well as the amount of the delivery costs, The total of the order, the user's details and the delivery address.

DMN is unable to group multiple unshipped commands.

3.4 Final Validation of the order

After having read the details of his future order, and once all the information requested has been completed by the user, he will have to pay the order in order to confirm it definitively.

In the case of a credit card payment, the user will then have to fill in certain information relating to the credit card used:

-The name of the credit card holder,

-The credit card number,

-The expiration date of the latter,

-His cipher number.

It is specified that with immediate payment by credit card, the means of payment offered by DMN on its Internet site, the User will make payment via the DMN site using the STRIPE TPE (Electronic Payment Terminal) system. Thus, the User's banking data is sent to the bank, which is itself secured by S.S.L. encryption and at no time will the User's banking data transit through DMN's computer system. DMN's responsibility is therefore released in this respect.

As soon as he validates his payment by credit card or PayPal, the order is registered and becomes irrevocable. The user becomes a buyer. The order form will be recorded on DMN's computer registers, which are kept on a reliable and durable medium, and will be considered as proof of contractual relations between the parties.

3.5 Confirmation of the order

When he has validated his payment by credit card (with the supply of his card number, the expiration date and the cipher) or Paypal, a summary of the buyer's order will be sent by e-mail, upon receipt of the purchase order, to The email address indicated by him at the time of the order. This confirmation will take into account all the components of the contract between the Parties, as well as an estimate of the date of dispatch.

DMN recommends that the purchaser retain his/her order confirmation email or print it. However, the documents archived in the DMN computer systems will be considered as legal evidence. A summary of the order will also be displayed in the customer account.

Art. 4. Purchase or discount Voucher, sponsorship

4.1 Issuance of Coupons

Coupons are materialized by a code that will be entered or that has already been assigned to the customer account. A code can be sent by e-mail or mail during special operations or the customer will be informed by e-mail of the assignment of a coupon in his account.

4.2 Terms of use of coupons

Unless otherwise stated in particular related to the use of a purchase voucher or a discount when registering a first order, several purchase or discount vouchers may be used on the same order. In no case can it be converted into a currency. The issued coupons include an expiration date that cannot be changed. No new coupon can be issued or assigned to a user to replace an expired and unused purchase voucher or discount.

The application of a purchase or discount voucher necessarily implies that the value of the basket (before the calculation of the delivery costs) is greater than the value of the purchase or reduction voucher, except in the case where the special conditions of use of the said Purchase or discount voucher specify a minimum purchase amount (before the cost of delivery is calculated). In this case, the value of the basket (before the calculation of the delivery costs) must be greater than the minimum purchase value required for the use of the coupon.

A purchaser may not in any case ask DMN to deduct from an order already validated and paid the value of a voucher or coupon whose code has not been entered, selected or would be defective, when it has been passed.

Vouchers or coupons are valid only on the DMN website. They may not be used for the purchase of gift cheque (s).

4.3 Use of purchase or discount vouchers

In order to benefit from the reduction associated with a voucher or discount, the user will have to enter his code assigned to him in the window "Enter your coupon code or your gift voucher" or click on the link "use the vouchers or discount And the gift certificates you collected. "

After entering or selecting the purchase or discount voucher, the user will have to click on the "Ok" or "Validate" button. The reduction will be immediately deducted from the amount of the order.

4.4 Refund of an order containing a coupon

When an order contains a purchase or discount voucher, the amount of the purchase voucher or discount is broken down on all the items of the order in proportion to their respective value. Art. 5. Payment

5.1 Amount of order

5.2 Methods of payment

The payment in 3 times:

The payment in 3 times is a solution of payment in 3 times by credit card, Visa or Mastercard which makes it possible to spread out the order in 3 withdrawals with the following schedule: 1st withdrawal the day of the order: 1/3 of the amount of the basket - 2nd withdrawal 30 days after: 1/3 of the amount of the basket - 3rd direct debit 30 days later (i.e. 60 days after the order): 1/3 of the amount of the basket.

5.3 Confirmation of payment

The order will be considered valid after confirmation of the Bank payment agreement. If the bank refuses, the order will be automatically cancelled.

In any event, DMN reserves the right to refuse any order or any delivery in the event of a dispute with the purchaser, of total non-payment or partial payment of a previous order by the buyer, of refusal of authorisation of payment by credit card banking institutions. DMN will not be liable in the event of a dispute.

Art. 6. Delivery

6.1 Time for shipping and delivery

The time limit for the dispatch and delivery of an order corresponds to an indicative period from the day following the date of the validation by the purchaser of his order.

This period shall take into account the expected processing and reception deadlines by DMN of the articles which comprise the order. Under no circumstances may it be enforceable, but in the event of an unusual delay, an e-mail will be sent to the purchaser.

The average shipping time is between 48 hours worked and 1 week. At this time the carrier is added to the delivery address (2 working days).

Some of the items are purchased directly from suppliers to form a pre-stock. In general, these items are shipped within working hours.

6.2 Delivery

The items are shipped to the delivery address indicated by the buyer in his or her customer account. If the purchaser has several delivery addresses registered in his or her customer account, he or she can select one before finalizing its order and making its payment.

DMN assumes no responsibility for delays in delivery that are too large for postal services or carriers in General, and in the event of loss of goods during transport.

DMN undertakes to ship the order of the purchaser within the forecast time displayed when registering the order. In the event that this period is not complied with, DMN undertakes, at the request of the customer to terminate the sale, at the request of the customer, and to reimburse it within 72 hours.

6.3 Delivery outside France and EEC

Any order placed on the site and dispatched outside of France/EEC may be subject to any taxes or customs duties. These costs related to the delivery are borne by the buyer and are the responsibility of the purchaser. DMN is not obliged to inform the user of any taxes or customs duties applicable to the countries of delivery.

Art. 7. Right of withdrawal and returns

The purchaser has a period of fifteen free days to declare his return unless expressly stated. The withdrawal period runs from the day the order is received.

The purchaser may contact DMN customer service by logging in to their customer account or by writing to eShop @ DMN. Paris or directly via the website.

Items subject to retraction shall be returned in their packaging and original packaging to the following address:

The items will have to be returned in a new condition and suitable for resale. The items must be accompanied by all their accessories.

The returned items must have been used minimally, i.e. have been tried for a few minutes and should not bear any traces of prolonged use.

If the above conditions are fulfilled, DMN will reimburse the purchaser, within a maximum of one week from the date of receipt by DMN of the parcel, the sums paid by the purchaser, except however the return costs of the articles which remain the responsibility of the purchaser.

If the buyer returns all of his order, he will be reimbursed all the shipping costs. However, the reimbursement of the shipping costs will be modulated according to the weight of the items returned when the shipping costs depend on a schedule of delivery tariffs.

Exchanges are offered to customers who request them when registering their return request. DMN will be able to ship only once, at no additional cost, the same item of identical size, lower or higher only if it is available at the warehouse at the time of the logistic processing of the return. In the case of a price change between the purchased item and the traded item, no refund of the price difference will be made.

The costs and risks associated with forwarding are borne by the purchaser. Therefore, it is up to him to keep all the evidence of this return. DMN therefore advises the purchaser to return the items by consignment followed by recommended type or by any other means to provide proof of the reconsignment. These shipping documents must contain the following information: consignee's address, date of dispatch and parcel number.

7.2 Return expenses

The cost of return is the responsibility of the purchaser.

Art. 8. Computer Science and freedoms

8.1. Personal Information

9.1 Information on articles

For each item on sale on the site, DMN undertakes to provide a descriptive sheet to present the essential characteristics, within the limits of the information provided by the suppliers. DMN makes every effort to provide the user with as much information as possible to know the articles before registering their orders.

Despite all the care given to the drafting of these descriptions, an error could slip. If the user finds an inconsistency, he will be able to contact the customer service to inform him. DMN then undertakes to proceed as soon as possible to the correction of these errors.

The photographs as well as the descriptions of the articles are not contractual and DMN will not be liable in any way for any errors that may exist.

In particular, the images and colors of the articles displayed on the site might not be exactly true to the actual colors of the articles under the effect of the Internet browser used as well as the resolution of the user's screen.

DMN sells top quality items. However, some items sold have "vintage" effects and involve intentional and deliberate deterioration by the manufacturer (holes, discolourations, whiskers, permanent folds...). These items were dealt with in order to give them a particular aspect. The details added to the fabric are sometimes made by hand. It is therefore impossible to ensure uniformity of the articles. Thus, it is normal to see differences between the article photographed and the article delivered.

9.2 Legal Warranty

DMN intervenes as an agent of professional suppliers. The latter guarantee that the items sold are of top quality and are shipped in good condition, and have no defect or latent defects making the items unsuitable for their normal use.

DMN is nevertheless bound by the guarantee due to the hidden defects of the sold thing.

In order to benefit from the legal guarantee, the following conditions must be met:

- the defect affecting the property must be serious; it must prevent normal use of the property or diminish its properties to such an extent that the buyer would not have bought it or would have offered a lower price for it if he had known about it;

- the defect affecting the good must be hidden; the seller is not liable for apparent defects, i.e. those that an average person of diligence would have discovered by carrying out elementary checks upon receipt of the product ;

- the defect affecting the goods must have occurred prior to the sale even if it manifested itself later; the Buyer is subject to an obligation of prudence in the use of his articles. Proof of a defect caused by negligence, deterioration or non-conforming use would render ineffective the guarantees associated with the article (All causes external to the article such as a shock, a fall, lightning, oxidation, repair by a non-approved person, exposure to heat, washing incident...) ;

9.3 Liability

DMN's liability is limited to the amount of the buyer's order.

DMN's involvement cannot be challenged for any inconvenience or damage inherent in the use of a computer, computer network or Internet. In particular, DMN cannot be held responsible for any breach of service, external intrusion or the presence of a computer virus. DMN has only one means obligation for all stages of access to the site, including consultation, form filling, ordering, payment and any other service available on the DMN website.

DMN shall not be liable for any material, immaterial or bodily damage caused by the malfunction or misuse of an item purchased on the site.

It is the responsibility of the user to check with the local authorities the specifics as to the taxes, declarations, prohibitions, possibilities of importation or use of the ordered items. DMN shall not be liable in the event of non-compliance with the legislation of the country where the articles will be delivered.

Art. 10. Intellectual Property

All elements of the Site, whether visual or sound, including the underlying technology, are protected by copyright, trademarks or patents.

They are the exclusive property of DMN.

Art. 11. Partial Disability

In the event that one of the clauses of this contract is null and void due to a change in legislation, regulations or a court decision, this shall in no way affect the validity of and compliance with these general conditions Use.

Art. 13. Duration

These terms and conditions apply throughout the duration of the online delivery of the articles offered by DMN.

Art. 14. Force Majeure

DMN shall not be liable for the total or partial non-fulfilment of its obligations under this contract, if such non-performance is caused by an event constituting force majeure, in particular in the event of a disturbance or a total or partial strike including postal services and means of transport and/or communications, flood, fire.

Events meeting the criteria established by the jurisprudence will be considered as a case of force major.

In the presence of a force majeure event, DMN shall notify the user/purchaser within eight working days of the occurrence or threat of such event.

The Parties agree that they will have to consult as soon as possible in order to determine together the terms of execution of the order during the duration of the case of force majeure.

Beyond a period of one (1) month of interruption due to force majeure, DMN may not honour the order, to be liable for it to reimburse the purchaser if necessary.

Art. 15. Applicable law, jurisdiction

The General Conditions Use are governed by French law.

Any dispute to which the General Conditions Use Any disputes that may arise will be brought before the competent courts in accordance with the rules of ordinary law.
